all that I had said to him about the matter to Mr. Nisbet. I said

to him, "In that case I would side with neither. I would not give

evidence for either side. He said "all right, I'll tell Mr. Nisbet

about it".

Before this I was asked by the petitioners to advise them as

to which Counsel they should engage in the case. I suggested Mr.

Jenkin, and they agreed to it, and asked me to speak to Mr. Jenkin

and tell him to see the Registrar (Mr. Nisbet) with a view to

getting the case withdrawn. I told them to engage a Solicitor to

do that work for them and they went away. It happened that I met

Mr. Jenkin in the large Court of the Supreme Court imediately

after I left them and mentioned the case to him and conveyed to

him that the petitioners desired him to do. He said "all right,

let them come round to see me

At about 2 p.m. Hr. Jenkin met me in the Registry and hold me

that he mentioned the case to Mr. Nisbet in the Hongkong Club at ■

tiffin time and that he (Mr. Nisbet) asked him who told him about

the case, and that he mentioned my name. Mr. Nisbet was very

serious and told Mr. Jenkin that I had no business to interfere in

the case and that he would see me about it. He did see me about it

and gave me a proper telling off, whereupon I behaved very im-

-pertinently. Later in July he told very popular Solicitor in the

Colony when he went to see him in the Registry about a probate

file that could not be found, that the cause of my trouble was too

much private lawyering in the Registry. I behaved generally in

the Registry in a very independent manner and always stood up to

claiming my rights.

He refused to support my claim for promotion in June last. He

refused to forward my application to the Government appealing

against the decision of the Board of Civil Service. I insisted and

then he forwarded it to the Government with the following recon

-mendation:-

"Forwarded as requested by Mr. Alim Khan".

He said my application was hostile and made me frame it in milder words. I submit there were 31 changes in the service and
